I asked this before, and people said to be more specific.

OK, things like the last election cost $5.8 billion, with taxpayer money going to advertising companies, lawyers, public servants who administer the election and various other interest groups. Now would you want to reduce your liberty in abolishing the voting system so that this money can be spent on building schools, hospitals and creating jobs for your family?

Things like the current budget crisis, the Tea Party is trying to get more federal funding in their states to get more votes, would you put aside your political interest for the greater good of the nation and the average American?

America have more police and prisoners than China, even though US have at least 3 times less the population. This is a FACT. Would you put away your liberty to own guns as your hobby for the greater good of the nation?

During Hurrican Katrina, it was a big mess with people shooting guns at aid helicopters and looters rampant. Would you reduce your liberty for a tougher system like China, where police are given authority to shoot armed looters on sight and those prevent aid during a national emergency?

Last week I saw a man refuse to sell his house blocking a national highway, that cost the government millions in delays but he refuse to sell. Would you reduce your personal liberty like in China where government would forcibly remove your house after if you refuse compensation for delaying a national project?

all of my life’s possessions including my home was confiscated illegally by the police in rosarito, mexico by gun point. all our money, home, financial means of employment, birth cirtificates, cars, and you name it, was stolen/taken from us as we were arrested and deported for nothing. we need an advisor. we have called just about everybody and agency, but everybody seems to back away when they find out that the cartel was behind this move to get one of their properties back. all we tried to do was start a non-profit clinic. i am a 61 year old veteran and my wife is 51. we just can’t start a whole new life again at the toss of a hat. we know that we’ll never get the money or the building back again, we just want our business & personal belongings. does anyone have any idea’s? we already tried the american consulate. they don’t want to get involved. it seems like all they are is a lawyer referrel system, which we cannot afford at this time. the mexicans made sure of that.

Forget it. You are dealing with Mexico, Mexicans, drug lords, crooked police, crooked lawyers, crooked judges. You will definetly not get any belongings back. The police took them and are either wearing the clothes or someone in the family is, all the other stuff has been shifted around. On august of 2009 me and my wife were leaving the dollar general store as i got into my truck a truck blocked my truck from leaving the parking spot as i looked in my mirror i could see a truck full of young black people 7 to be exact 6 males one female, girl was the driver it was very intimidating,so trying not to bother them i decided to inch my way out of the parking lot by a lot of reverse drive motions, these troublemakers noticed what i was trying to do so some of the males got out of the vehicle and approached my driver side and begin to threaten me with bad words and let me know that i was not allowed to leave until they decided they where finished talking i was left with no choice but to step out of my car and confront these young men,after they decided to park like they should have done in the first place me and my wife went home only for the police to come to our home with accusations that i had threatened them with a gun the police whom i still have his card today found no such weapon and told me and my wife that if we have any problems to contact him. we went to the store for toothbrushes deodorant and things for our trip to Louisville.Upon returning to Tulsa i was pulled over only to find out that i was falsely accused after spending a night in jail i had to post a 2100 dollar bail,to make a long story short i went to court five times hoping to confront these lies, each time me and my wife came to court these people would not show up the D.A would call them in front of us only to hear lame excuses why they could not be present finally after the fifth court appearance and third judge he decided to dismiss it everyone(50 different lawyers have told me theres nothing i can do to get back my losses(truck put up for bail money)lawyer fees this is my last hope can you please tell me where is the justice because i have just about giving up do thugs have more rights than the law abide citizens.

You cannot sue the city, they were acting on a legitimate claim of threatening. Once such a report is filed, the DA will proceed to court. He had multiple witnesses. The city has no liability on that.

The ONLY thing you can do is sue the people who made the original claim. HOWEVER, a charge which does not result in a conviction is a far distance from a lawsuit. You would have to prove that the charge was false, and that they KNEW it was false. A mistake on their part or them failing to prove their case is not filing a false report.

Can the “Trustee” of a Living Trust switch attorneys?

After my Mother died, my Dad went to a new attorney to change his Living Trust in his name.

After my Dad died last year, my sister, being the executive, took the Living Trust and went back to the original attorney stating that the original attorney specializes in Trusts and Estate Planning.

I am not certain that I understand the facts of your situation. Often a husband and wife will have a joint trust and the survivor would be entitled to do with the assets of the trust as they see fit. (There are many many variations and this is one of the reasons Trusts are used so often, is because of the flexibility they provide.)

Upon your father’s death the trust became, irrevocable, meaning that the duties and responsibilities of the trustee to the beneficiaries became fixed. The term “executor”, is used to denote the person named in a Last Will and Testament that is selected as the responsible person to administer a person’s probate estate. The use of a Trust is often to help avoid probate. So while your sister might have been the “executor” she might not had much to do since all or nearly all of your father’s assets were in the Trust and not in his estate.

The trust would include the person named as Successor Trustee to administer the Trust upon your father’s incapacity or death. It may be that your sister if she was named executor was also named as the Successor Trustee.

At this juncture, the named Successor Trustee likely has a lot of flexibility in selecting the attorney to assist them in administering the trust. You might want to consult with your own attorney to help guide you through this process and let you know your rights. It sounds like you are feeling ignored or simply left out in the dark and would merely appreciate some information. You could call the attorney your father went to after your mother’s death and ask him to help you. He might be willing to give you an initial free consultation.

BTW, conversations your mother and father had with their attorneys should not be disclosed to you. The attorney client privilege can only be waived by a client and therefore discussions they had with your parents cannot be disclosed. (That is really an issue for the attorneys involved.)

My friend read on a divorce website that both the plaintiff (my friend) and the defendant (her husband) has to appear in divorce court in order for the divorce to go through.

I’m not sure that would work with a Petitioner. The Respondent is able to sign all the necessary documents to be presented to the Court through his attorney but the Petitioner has to confirm the allegations in her Petition to the Judge. Call the Clerk and ask if it’s possible.

As I have worked in a family law Court, I find people who spend that much on their divorce are CRAZY. Generally it is because you are vindictive and can’t let anything go. It is either you or the other person or both who are nuts. And let me get this straight, two lawyers and judges (plural) are screwing you? It must be a conspiracy against you because these people hate you for no reason, right? Are you spending this much money so your former spouse gets less? Would you spend 40K to make sure she gets 20K instead of 30K? Would you spend all your assets just so she doesn’t get them.

Do You Support The States That Filed “A Friend Of The Court” Brief For Arizona SB 1070D?

Last Wednesday, the attorneys general of eight states and one U.S. territory filed a “friend of the court” brief in the federal lawsuit (U.S.A. v. Arizona) to support Arizona’s new immigration enforcement law, SB 1070. (Cox Press Release, July 14, 2010). Led by Michigan Attorney General Michael Cox, other signatories included the attorneys general from Florida, Alabama, Nebraska, Pennsylvania, South Carolina, South Dakota, Texas, Virginia, and the Northern Mariana Islands. Because the federal court has limited the length of such amicus briefs, the states’ argument goes straight to the heart of the federal complaint: preemption.

In their brief, the states forcefully refute the Department of Justice’s argument that SB 1070 is preempted under the United States Constitution. First, they reject DOJ’s argument that SB 1070 constitutes an impermissible “regulation of immigration.” Case law, they argue, has defined a “regulation of immigration” as defining who should or should not be admitted into the country and the conditions under which a legal entrant may remain. SB 1070 does not do either. Moreover, the states point out that federal courts have long held that state law enforcement officers have inherent authority to arrest for violations of federal law as long as the arrest is authorized by state law. (Amicus Brief)

Second, the states reject DOJ’s argument that SB 1070 conflicts with federal laws such that it “stands as an obstacle to the accomplishment of the full purposes and objectives of Congress.” SB 1070, the states argue, is fully consistent with Congress’s intent of apprehending illegal aliens even if it does not facilitate the Executive’s wish to selectively abandon the enforcement of immigration laws. Moreover, the states argue, SB 1070 does not interfere with the Executive’s discretion in how it treats aliens as DOJ claims because the federal government still retains that discretion once Arizona law enforcement officers turn over an illegal alien to federal authorities. (Id.)

In a statement released with the brief, Michigan Attorney Michael Cox said, “Arizona, Michigan and every other state have the authority to enforce immigration laws, and it is appalling to see President Obama use taxpayer dollars to stop a state’s efforts to protect its own borders.” (Cox Press Release, July 14, 2010). Others who joined the brief sounded a similar note. Virginia Attorney General Ken Cucinelli remarked, “Federal law expressly allows states to arrest people who are not legally present in the United States. Arizona’s law doesn’t change any of this. That’s why we are stunned that the government has sued Arizona.” (Cucinelli Press Release, July 14, 2010). South Dakota Attorney General Marty Jackley said South Dakota joined the amicus brief because federal authorities aren’t doing enough to enforce current immigration laws. “We felt it was right for the state of South Dakota because this is really a public safety issue,” said Jackley. The government is basically saying that it has a right to selectively enforce or not enforce laws. The government argues that it wishes to concentrate its resources on “dangerous” illegal aliens and that states like Arizona will interfere in this. But does that make sense?

If an immigrant is dangerous than the police are already responsible for arresting them. It is no longer in the hands of the Department of Immigration if an immigrant is committing dangerous crimes. Is the government arguing that the Department of Immigration and Customs Enforcement now has jurisdiction over local robberies, muggings, rape, and murder? If that is true than are regular police only allowed to investigate crimes committed by legal citizens? How are they supposed to tell the difference? Obviously it is not true so why is the government claiming that it can only enforce immigration laws on dangerous criminals?

The government argues that if any state is allowed to create its own immigration laws than we will have no coherent policy. But, Arizona has crafted its law as a word for word imitation of our national immigration policies and laws. Arizona has not assumed the power to deport but only to turn illegal immigrants over to ICE. So this is no incoherent policy but simply additional enforcement of our existing policy. The argument that this will create wildly chaotic policies is whats called a slippery slope argument.

So we get back to the crux of the argument. Does the government have a right to selectively enforce the law? Can the government say Sahid is a criminal for crossing the border illegally but Pedro is not for doing the same thing. Can it say Mexicans may enter our country at will but Chinese and Syrians may not. Which is the more incoherent policy. And since slippery slopes are good enough for our government than how about this one. Is it ok for a major campaign contributor to commit a crime but a member of the wrong party will be held accountable to justice? If we have the right to selectively enforce our laws than does it end at immigration?

While I didn’t fully support the Arizona law before (I chose to wait and see) I do so now because it is revealing some uncomfortable policies of our government. I am glad Arizona made their law because I would hate to be surprised by this double standard later on when the government decides to selectively choose not to protect me from some criminal.

Now that Florida Follows Arizona’s Lead With New Bill Cracking Down on Illegal aliens will Obama sue Florida?

Florida has joined Arizona on the front lines of battling illegal immigration with a new bill released this week that seeks to crack down on the estimated 800,000 undocumented workers in the state.

The bill, filed by state Sen. Michael Bennett, allows law enforcement officers to check the residency status of anyone they suspect of being an illegal immigrant and would punish some legal immigrants who aren’t carrying proper documentation.

Florida has been flirting with releasing an immigration bill since the summer when outgoing state Attorney General Bill McCollum wrote a similar proposal with state Rep. William Snyder. But Snyder has yet to file that bill.

Snyder told FoxNews.com that he’s in no rush to file his bill and expects to unveil it next month. He said he is consulting with state Attorney General-elect Pam Bondi and minority communities who are concerned about the bill promoting racial profiling.

“Filing a bill is just pushing a button,” he said. “I could do that in instant. Getting people behind the bill is what legislation is all about.”Bennett could not be reached for comment. A spokesman for Florida Gov.-elect Rick Scott, who campaigned on cracking down on illegal immigrants in the state, did not return a message seeking comment.

Bondi said she is still reviewing the details of Bennett’s bill but expressed support for such a law.

“I am committed to working with the legislature in support of an immigration law for Florida that protects the public, guards against racial profiling and upholds the rule of law,” she said in a written statement to FoxNews.com. “I will stand up to any effort by the federal government to stop Florida from implementing such a law.”

When injured at work, shouldn’t the company pick up the portion one pays from paycheck for insurance?

I was injured at work, and have been on disability for the past year now. Shouldn’t the company pick up the portion that I paid from my bi-weekly paycheck for my health insurance? The Company is now telling me I’m still responsible for paying them my portion that would be deducted from my paycheck so that my health insurance can be kept active (My disability check is small, and they expect me to still pay my portion from there)? Is this company cheap? Is this right/wrong? Should I get a lawyer?

Nope, I was on comp for almost an entire year, lost the insurance for that time period but as soon as I started back at work the insurance was re-instated.

What do you think of this idea to increase newspaper readership?

Obviously the decline of newspaper readership has led to an apathetic, ignorant and inattentive electorate, not to mention a less profitable industry.

What if the U.S. government regulated the media (especially newspapers and magazines) by certifying journalists?

For example, it is not possible to be a lawyer without graduating law school and passing the bar exam. Or it is not possible to practice medicine without attending medical school and completing a residency requirement.

How do you think such a law would positively or negatively affect newspaper readership?

I for one think that it would enhance the credibility of sources that employ certified journalists while diminishing the credibility of those that aren’t. As a result more people will read from the credible sources, which would be such publications as the Wall Street Journal and National Geographic rather than US Weekly or People.

Honestly, I don’t think it will make any difference. People don’t read the newspapers or magazines because they are tired of the slant. It’s easier to listen on the radio or pull it up on the internet. You could try it but I don’t think it would increase readership.

i joined a kirby distributer and actully sold a kirby system. i was told pay would be 800 bi-weekly and 160 for commision. I recently discovered that this is a scam and am goin to quit. I just need to know if i quite on monday if im entitled to atleast the comp from the system i sold and if i dont receive if i need to contact my lawyer.

I don’t know if you are entitled or not. When did you expect they would pay you? If you can just hang out till you get paid for your sale that would help. Is it a job? How are they paying you $400 a week? I assumed Kirby was commission only.

Read over the agreement you signed with them and see what that says.

The last thing I would say is this– Go to your boss and say, “Hey, when am I going to get paid for that unit I sold?” Let him give you the answer. Then say, “I am not sure I am going to stick with this.” Then see what he/she says… Don’t quit that day- wait a day or two and say, “Hey, I am going to resign but I will come by to pick up my check on (the day he said).” Do not give him a chance to tell you you won’t be getting it.

Then just hound them for it until they pay up. But whether you are SUPPOSED to get it goes back to the agreement you probably have in writing.

will not go to court without the deposition from the victim. But the victim is not showing up for her deposition. What will happen to the case if she does not give a deposition? It is felony battery case
Meaningless.., ? And yes it does exist, I wish it did not exist but she has not shown up for two appointments with MY attorney for a deposition. I don’t know much about the laws this is just what my attorney is telling me.!!!! So, why so rude, ?

Can my kids refuse to go on visitation? Can the police do anything to force them?

My 9 year old son wants to go on a camping trip for Cub Scouts this weekend. His father was not interested in attending with him, and unfortunately it falls on my ex’s visitation weekend. My 13 year old has an 8th grade graduation dance this weekend and her father won’t allow her to stay home to attend that either, yet he won’t take her to dance himself. Both of my children have texted and called their Dad telling him they don’t want to go with him this weekend. He is ignoring them and will be coming at 7pm Friday. I offered to switch weekend with him and other options in order to save my kids from missing these events but he won’t even talk to me about it. I’m sure there will be a show-down tomorrow when he picks them up and he will call the police. Can the police force my kids to go? My attorney says they can’t..but what I’m reading on the internet says the opposite. Can anyone offer solid advice?

BTW..I live in Mchenry County, Illinois if that matters. And my ex willingly gives up visitation at the drop of a hat..hasn’t seen them in over a month by his choice ..always picks up late/ drops off early and leaves them home anytime he feels like it. He never calls them in between his weekends to say hello or attend their games etc. I have an email from him saying that if my kids have activities, basketball, Cub Souts..they can stay home..and now he’s done an about-face. This is basically a power play because he doesn t want my son spending time with my family on “his time”.

#1. I am not “creating activities” to keep my kids away from their father. I have four children with this man. They have ALWAYS been in sports , involved in school etc. Their lives should not have to come to a halt bc of his visitation. He can attend their games and parent them just as well as I can. He asked me..in front of my son.. if he could sign my sign up for Cub Scouts at the beginning of the school year. I said absolutely..I said he could take my son to his meetings and events even if it wasn’t “his time” with his son. He then told my son weeks later that he shouldn’t have to take him to Cub Scouts..that I should do it.
I DID ask about the camping trip. He said my son could go..but he didnt’ want to take him!

My understanding is that if you don’t produce the kids, the sheriff will come and take them out, even if they refuse to go. I recently went over this in some detail with my attorney when my ex threatened to not return my kid after summer visitation.

You’re undermining your children’s emotional health and their relationship with their father by your behavior. You have multiple posts here all about trying to keep your children away from their father in general. You don’t like his driving, you don’t like his girlfriend, you don’t like him – that’s all fine. But his kids love him, he loves them, and their relationship with him would be one of your top concerns if you were focused on being a good mother instead of still focused on the bitterness of divorce. Where I live, and I think most places, there are mandatory classes in how to rise above that for the kids’ sake and why it’s important.

Here’s how things look from a father’s point of view:

We only get to see our kids for 48 hours every 2 weeks. We miss them a lot. We hardly know them after a while except for that month in the summer, especially teenagers who live in their rooms. You have them all week and are there for the moments when they open up and want to talk. We aren’t. We don’t call between visits because our kids won’t much talk to us while they’re home, because they think they have to show loyalty to their mother. We go to what games we can, but we often have to miss them because we’re working. I have custody of my youngest daughter now, a 9th-grader, but I remember how it was when I didn’t.

I remember the “power plays”, as you put it, similar to what you’re doing – scheduling activities for my kids on my weekend. I hated that. It put me in the position of telling my kids they couldn’t do something fun my ex had promised them or giving up seeing them. So I used my best judgment. Sometimes I said, go to the dance. Sometimes I said, no, you can’t go on that camping trip. Because I wanted my kids to have fun with their friends, but I wanted time with them. It was a crappy choice to give me.

And it’s a crappy choice you gave your husband. Switching weekends is reasonable, but he may have plans on the next weekend that make it unreasonable. Who knows. For this weekend, you’ve left him only bad choices. Choice 1, do what you say and go on a camping trip you scheduled for him that he doesn’t want to go on so that he can have time with his son, and get no time with his daughter. Choice 2, let his son go camping without him and stay home with his daughter, who’s now mad at him – with her mother’s encouragement – because she’s missing one of 30 dances coming up over the next 4 years. Her mom is teaching her that a school dance is more important than time with her father. You should read the statistics sometime about the correlation between sexual activitiy, drug use, and grades with lack of father time, and then decide how important it is to stand around with her friends in a new dress for a couple hours. You don’t want to wonder, when you’re getting her birth control next year or catching her drunk and high with a college boy, if it’s because you messed up her relationship with her father. Nobody acts out worse than a teenaged girl who has no relationship with her father. And why can’t she go to his place and go to her dance from there, wtih him picking her up? Does he live hours away? I had no problem taking my kid to her 8th-grade dances and picking her up and taking pictures of her and her friends. My ex-wife interfered as much as she could, but not so much I had to not see my kid the night of a dance.

Choice 3 is to let you deny visitation and not see his kids. And choice 4 is to call the sheriff and have the kids traumatized by being picked up in a squad car.

Short version – your kids’ time with your father is more important than a camping trip and a dance, and you shouldn’t schedule those things without your ex-husband’s agreement.

Married in Arkansas but live in Alabama. How would someone go about getting a divorce.?

My son was married in December of 2009 but him and his wife separated in April of 2010. There are no kids involved or property and this is a non-contested divorce. Can he file in Alabama since that is where he lives now, or does he have to go back to Arkansas to file? Also, can this be done without hiring an attorney? Thanks for all info provided.

First and foremost, you need to realize that no one will be able to adequately answer in depth legal questions without knowing background information on the situation with your son. Those sorts of questions would be far better off for your son to ask an attorney during an initial consultation.

If he has met Alabama’s residency requirements (which can be found at the first link in the source section), then he can file in Alabama. If his wife has met the residency requirements in Arkansas, then your son can file in either state. However, he should consult with attorneys in both states and learn what each state has to offer and which state would be better for him. But once she has filed, in whichever state she chooses, he cannot then chose the state for himself – he is forced to go to the state she has chosen and all expenses would be his responsibility (such as being at the court at the appointed date and time). You can get a quick review of state laws in the same link I provided below.

If children are involved, all matters involving the children fall to the state where the children have resided for 6 months or more. That is non-negotiable unless your son can show valid and good reasons why the case should be moved to another state. This is more difficult than it sounds.

We make the analogy to persons considering self-representation to that of a person who has a cracked tooth or a broken arm deciding to fix themselves without a dentist or doctor. Can they fix the problem? Certainly. Will they enjoy the long-term ramifications of the “do-it-yourself” fix? Almost certainly not. In most states, litigants who choose to represent themselves pro se rather than through counsel are held to the same standards as if they were an attorney. This means that even if they don’t understand the legalese language or the potential ramifications of the legalese language being used in their divorce decree, the pro se litigant is generally going to be bound by what they produce.

The second link I have provided you with is to an article about pro se. While you are at that website, you might want to do some research into the issues that your son will be facing, in addition to pro se divorces.

Is it OK to contact the Plaintiff’s lawyer when being sued?

I’m being sued in a Civil case in which the Plaintiff is trying to collect on a junk debt. I wrote a Pro Se Answer to both the court and the Plaintiff’s lawyer explaining that either the debt is passed the Statute of Limitations or they are trying to collect on loans that are already being paid and attached paperwork to prove it.

I was wondering if I could call their lawyer to see if they’ve reviewed my answer and realized that the debt is non-collectible.

The defendant’s attorney always talks to the plaintiff’s attorney. Since you’re acting pro se, you are your own lawyer and it’s perfectly appropriate to call the plaintiff’s lawyer. However, having dealt with more pro se “answers” than I care to recall, I doubt whether the attorney has taken the “answer” seriously.

Corbett knew about the Penn State allegations in his previous position as state attorney general. Corbett then condemns the university for not reacting better, when he had higher authority to do so? He had the ability to get rid of the higher ups at PSU years ago but did not do so. Rather he pissed on PSU and Joe Paterno for not doing enough. Then today he orders flags around PA to flown at half-staff for a man whom he pissed on and degraded his university when Corbett himself could of done more.

So, if you’re a Dem, have you ever voted for a Rep, and vice versa. Preferably a Senator, Governor, or President, someone that you can remember voting for. Say who it was, and why you voted that way. I’m a registered Dem, but I voted for a Rep for Governor here in PA last November. I was a registered Republican, and then a Dem, and went back to Republican. I only put a party down since I want to vote in the primaries. I vote for the person that I think will do the best job. I have voted for a candidate because I thought he or she was the least of two bad choices.

I have seen so much local corruption and graft that it numbs my mind. I shudder to think of what happens in Washington. I think career politicians are a bad idea, but that’s what makes a power base.

You need virtually straight A grades to be admitted to Princeton for undergraduate school. Princeton does not have a law school, but is a very good place to earn the bachelor’s degree which is required for law school admission.

If you want to go to Princeton and then to law school, you need to learn to use perfect grammar when you write.

Ivy league schools like Harvard and University of Pennsylvania have good law schools.

What do I do about an attorneys office that is calling my home?

My husband and I rented a clarinet for my daughter for school and we truly forgot to return it – now we have an attorneys office calling our home telling us that we have stolen equiipment! my husband explained the situation and he did not want to hear it, he threatend my husband with a bill of $639.00 and told him that we had to pay and could not return the clarinet to the company, when my husband asked for his name he refused to give it to him and hung up on him. At that point my husband called him back to try and resolve the situation and the attorneys office told him that he did not want him to pay the bill but in fact wanted him to pay by suffering with the police that would be showing up at my door to arrest him with possession of stolen property and then told my husband that he better get himself a good attorney becasue he is about to have a terrible week, and if he called his office again he was going to have him charged with harrasement. What can I do?

Approved for unemployment in California and never got money, Can I still get retro pay?

In 2007 I had a hearing and was approved for Unemployment and my case worker never sent me the weekly forms and when I would call he never helped me. I got all the forms late and was denied any money to that point, about 5 months in. He never sent out any other forms but I never did anything about that. 2010 now, can I get retro pay? Could a lawyer help me or public defender? What can I do?

I am a born american. i married a man 3 years ago who swam from Guatemala 7 years ago. we have a 1 year old daughter. my husband was caught in texas when swimming and they released him on a year visa when the year was up he was meant to go to court to be deported and he never showed. so my husband currently has deport status. all the lawyers tell me there is nothing i can do other than have my husband go back to guatemala and wait for 10 years then petition for him, unfortunately that is not an option because my husband is the only bread winner in his entire family in Guatemala and we send them money weekly just to eat and have electric. Has anyone had a similar situation that can advise to what we should do? my husband is in no rush to get papers its me worried that something could happen and he’ll get deported. He has never been in any trouble here with the police other than when he was caught in Texas. Please Advise. Desperately seeking advise.

Retaining an attorney will be helpful to you in this situation.
You can file what is called the “Application for Waiver of Ground of Inadmissibility” otherwise known as a I-601 hardship waiver. Your husband however must be back in his home country for you to do this. Of course beffore you can file this waiver, you must have petitioned him for the I-130 Petition for Alien Relative….it will be denied as he entered the country uninspected.
Once the I-130 is denied ONLY THEN can you file the I-601 waiver. Mind you, This can take up to 18 months and he will have to attend a interview at the US consulate in Guatemala. You will also have to write a Hardship letter describing why he should be admitted and what the hardship is. If accepted, he will be allowed to enter the US and then to adjust his statue to a legal resident. This is a long process…but this may be the ONLY legal process you may have and it will seperate you from your husband for a long period of time….and even then there is no gaurantee they will grant him admission back into the US.
